The process of Divorce is traumatic. The risks in each divorce are different. The goal of the client should be to minimize the impairment of family relationships and the loss of assets. . The attorney's job is to make sure his client is well represented, and to guide the client through the divorce process. A good attorney will tell a client if his or her goals are unrealistic. A good attorney will also advise a client if his or her actions will hurt the case.

In any case involving minor children, decisions must be made concerning child custody, visitation, and child support. In any case where there are assets, decisions must be made concerning how those assets are to be divided. As in any court case, there is no one black and white answer. Lawyers look to the written law and their past experiences in representing clients before the court, and with this roadmap, they guide their client through the divorce maize.

The Court will expect the parties to attempt to work through the issues of custody, support and property settlement with the aid of their attorneys and a mediator if necessary. Once an agreement is reached, the attorneys will prepare a judgment and present it to the Court for approval. Once approved by the court, the divorce is granted.

If the parents are unable to agree, a trial will be set on the contested issues, and each party may testify, produce exhibits, and call witnesses. The Judge will listen to the parties and their attorneys, review the evidence, and make a decision on what he believes to be fair. While the Judges goal is to do "Justice", he or she could be limited by not understanding the evidence, not having relevant evidence presented, and the Judge's own prejudices. A lawyer uses his skill to make sure that all relevant evidence is submitted. He argues the client's case to demonstrate that the client's position is fair.
