CRIMINAL LAW

 

I have limited my criminal law practice to serve those who are not, in my opinion, "Career Criminals". I have also made a conscious choice not to represent "habitual offenders". I do represent those persons who are first offenders, and occasionally second offenders who are in my opinion not involved in repetitive criminal actions.

Criminal Law encompasses charges brought by the State. The State is represented by the Prosecuting Attorney's office, City Attorney's office, or in a Federal case, the US Attorney's office. Misdemeanors are brought to trial in the District Court, and Felonies are tried in the Circuit Court after a preliminary examination in the District Court.

Drunk driving and other serious driving offenses are criminal proceedings, but minor traffic offenses have been "de-criminalized" and are now called "civil infractions".
